{"id":814,"date":"2016-01-22T09:20:46","date_gmt":"2016-01-22T16:20:46","guid":{"rendered":"http:\/\/TimeZoneReport.com\/?p=814"},"modified":"2016-01-22T09:20:46","modified_gmt":"2016-01-22T16:20:46","slug":"oklahoma-and-south-dakota-file-year-round-dst-bills-for-2016","status":"publish","type":"post","link":"https:\/\/TimeZoneReport.com\/?p=814","title":{"rendered":"Oklahoma and South Dakota File Year-Round DST Bills for 2016"},"content":{"rendered":"<p>One bill was filed in South Dakota yesterday seeking to implement Year-Round Daylight Saving Time, and a whopping four DST-related bills were pre-filed in Oklahoma for their February 1 session start.\u00a0 Two of the Oklahoma bills propose Year-Round DST, and the other two propose to drop DST entirely.<\/p>\n<h1><!--more-->South Dakota Details<\/h1>\n<p>South Dakota had <a href=\"http:\/\/TimeZoneReport.com\/?page_id=261\">a bill last year<\/a> in the House sponsored by Representatives Kaiser and Campbell, and co-sponsored by Senator Jensen.\u00a0 But this\u00a0year&#8217;s bill originates in the state senate, and has a show-drift of names on the sponsor list:<img loading=\"lazy\" decoding=\"async\" data-attachment-id=\"815\" data-permalink=\"https:\/\/TimeZoneReport.com\/?attachment_id=815\" data-orig-file=\"https:\/\/TimeZoneReport.com\/wp-content\/uploads\/2016\/01\/TZR-SD-HeaderSponsors.png\" data-orig-size=\"748,295\" data-comments-opened=\"1\" data-image-meta=\"{&quot;aperture&quot;:&quot;0&quot;,&quot;credit&quot;:&quot;&quot;,&quot;camera&quot;:&quot;&quot;,&quot;caption&quot;:&quot;&quot;,&quot;created_timestamp&quot;:&quot;0&quot;,&quot;copyright&quot;:&quot;&quot;,&quot;focal_length&quot;:&quot;0&quot;,&quot;iso&quot;:&quot;0&quot;,&quot;shutter_speed&quot;:&quot;0&quot;,&quot;title&quot;:&quot;&quot;,&quot;orientation&quot;:&quot;0&quot;}\" data-image-title=\"TZR-SD-HeaderSponsors\" data-image-description=\"\" data-image-caption=\"\" data-medium-file=\"https:\/\/TimeZoneReport.com\/wp-content\/uploads\/2016\/01\/TZR-SD-HeaderSponsors-300x118.png\" data-large-file=\"https:\/\/TimeZoneReport.com\/wp-content\/uploads\/2016\/01\/TZR-SD-HeaderSponsors.png\" class=\"alignleft wp-image-815 size-full\" src=\"http:\/\/TimeZoneReport.com\/wp-content\/uploads\/2016\/01\/TZR-SD-HeaderSponsors.png\" alt=\"TZR-SD-HeaderSponsors\" width=\"748\" height=\"295\" srcset=\"https:\/\/TimeZoneReport.com\/wp-content\/uploads\/2016\/01\/TZR-SD-HeaderSponsors.png 748w, https:\/\/TimeZoneReport.com\/wp-content\/uploads\/2016\/01\/TZR-SD-HeaderSponsors-300x118.png 300w\" sizes=\"auto, (max-width: 748px) 100vw, 748px\" \/><\/p>\n<p>View the bill details on the <a href=\"http:\/\/legis.sd.gov\/Legislative_Session\/Bills\/Bill.aspx?Bill=60&amp;Session=2016\" target=\"_blank\">SD state legislative web site<\/a>.<\/p>\n<p>The odd part of this bill is that it appears to put the state on DST but says the measure &#8220;may not be construed to affect the standard time established by the United States law governing the movements of common carriers engaged in interstate commerce&#8221;.\u00a0 Another attempt at getting around the restrictive provisions of 15 USB 260a.\u00a0 It&#8217;s highly unlikely the US DOT would permit this to stand without a challenge.<\/p>\n<h1>Oklahoma Details<\/h1>\n<p>A dizzying array of bills out of Oklahoma will surely give the legislature something to ponder in between their fracking <a href=\"http:\/\/earthquakes.ok.gov\/what-we-know\/earthquake-map\/\" target=\"_blank\">earthquakes<\/a>.\u00a0 So far we only have the titles to go by, since the state&#8217;s legislative web site links pointing to the text of the bills are all broken.<\/p>\n<p>SB 1228 and SB 1229 are both sponsored by Senator Yen, one of which seems to create the &#8220;Daylight Saving Time Preservation Act&#8221;, and the other proposes to adopt Year-Round Daylight Saving Time, with an effective date.\u00a0 It&#8217;s possible that either or both of these bills could tie in to <a href=\"http:\/\/TimeZoneReport.com\/?page_id=725\" target=\"_blank\">adjacent state Missouri&#8217;s bills<\/a>, which require 2 adjacent states to adopt measures similar to theirs in order to take effect.<\/p>\n<p>HB 2557 (sponsored by Rep. Wright) and HB 2853 (sponsored by Rep. Kouplen) are both titled &#8220;Daylight saving time; exempting Oklahoma from federal daylight saving time provision; effective date&#8221; (with the word &#8220;the&#8221; added in the title of HB 2853).<\/p>\n<p>So two bills leading to Year-Round DST, and two away from DST altogether.\u00a0 We remind you again that <a href=\"http:\/\/timezonereport.com\/?page_id=519\" target=\"_blank\">Year-Round DST can&#8217;t happen<\/a>.\u00a0 So only the House bills have any chance of becoming law at this point.<\/p>\n<div class=\"sharedaddy sd-sharing-enabled\"><div
