{"id":874,"date":"2017-01-12T09:06:40","date_gmt":"2017-01-12T16:06:40","guid":{"rendered":"http:\/\/TimeZoneReport.com\/?p=874"},"modified":"2017-01-12T09:53:59","modified_gmt":"2017-01-12T16:53:59","slug":"dsttz-bills-start-early","status":"publish","type":"post","link":"https:\/\/TimeZoneReport.com\/?p=874","title":{"rendered":"DST\/TZ Bills Start Early"},"content":{"rendered":"<p>We\u2019re not even two full weeks into 2017, and already there are 13 bill out of 10 states that related to some form of Daylight Saving Time or Time Zone Change legislation. <!--more-->Some of these bills were filed in late 2016 for this legislative session, but several have popped up just in the last few days.<\/p>\n<h1>Bills to Abolish Daylight Saving Time<\/h1>\n<p>There are six bills proposing to abolish Daylight Saving Time \u2013 or as the official language often reads, to \u201cexempt the state from 15 USC 260a\u201d.<\/p>\n<ul>\n<li>Connecticut \u2013 <a href=\"https:\/\/www.cga.ct.gov\/asp\/CGABillStatus\/CGAbillstatus.asp?which_year=2017&amp;selBillType=Bill&amp;bill_num=HB5090#\" target=\"_blank\">HB 6090<\/a><\/li>\n<li>Michigan \u2013 <a href=\"http:\/\/www.legislature.mi.gov\/(S(udihtou4vv4kgocneqqabnoc))\/mileg.aspx?page=GetObject&amp;objectname=2017-HB-4011\" target=\"_blank\">HB 4011<\/a><\/li>\n<li>North Dakota \u2013 <a href=\"http:\/\/www.legis.nd.gov\/assembly\/65-2017\/bill-index\/bi2167.html\" target=\"_blank\">SB 2167<\/a><\/li>\n<li>Texas \u2013 <a href=\"http:\/\/www.legis.state.tx.us\/BillLookup\/History.aspx?LegSess=85R&amp;Bill=SB238\" target=\"_blank\">SB 238<\/a> and <a href=\"http:\/\/www.legis.state.tx.us\/BillLookup\/History.aspx?LegSess=85R&amp;Bill=HB95\" target=\"_blank\">HB 95<\/a><\/li>\n<li>Utah \u2013 <a href=\"http:\/\/www.le.utah.gov\/~2017\/bills\/static\/HJR002.html\" target=\"_blank\">HJR 2<\/a><\/li>\n<\/ul>\n<p>Michigan&#8217;s text wasn&#8217;t available last I checked, but the title makes the intent pretty clear. The two bills from Texas are identical, but one is in the Senate, the other in the House.\u00a0 Utah&#8217;s bill requires a vote of the people first.<\/p>\n<h1>Bills for Time Zone Changes<\/h1>\n<p>Three states have bills proposing to request Time Zone changes.<\/p>\n<ul>\n<li>Maine \u2013 <a href=\"http:\/\/legislature.maine.gov\/LawMakerWeb\/summary.asp?ID=280062555\" target=\"_blank\">HP 58<\/a><\/li>\n<li>New Hampshire\u00a0\u2013 <a href=\"http:\/\/www.gencourt.state.nh.us\/bill_status\/bill_status.aspx?lsr=183&amp;sy=2017&amp;sortoption=&amp;txtsessionyear=2017&amp;txtbillnumber=hb209&amp;q=1\" target=\"_blank\">HB 209<\/a><\/li>\n<li>Wyoming\u00a0\u2013 <a href=\"http:\/\/legisweb.state.wy.us\/2017\/Introduced\/HB0049.pdf\" target=\"_blank\">HB 49<\/a> (link to bill text PDF; no link to status page yet)<\/li>\n<\/ul>\n<p>The bill from Maine just dropped onto the scene yesterday.\u00a0 The bill from new Hampshire would require Massachusetts to also pass a similar bill before becoming law.<\/p>\n<p>The Wyoming bill is more interesting, and sits in the same vein as many of the crazy bills from the previous two years we&#8217;ve been following this topic.\u00a0 Wyoming&#8217;s bill does say they&#8217;ll stop observing DST, but then goes on to say they&#8217;ll petition the DOT to be &#8220;transferred to the zone designated as United States standard central time&#8221;, but then they propose that once the time zone has been changed to CST, their time\u00a0&#8220;shall be known as mountain daylight saving time.&#8221;\u00a0 15 USC 260 and the DOT get to specify the names of the time zones, and if they say Wyoming can go to Central Standard Time, then that&#8217;s what it&#8217;ll be called.\u00a0 Year Round Daylight Saving Time doesn&#8217;t exist and isn&#8217;t allowed&#8230; why go and mess up your chances for a successful piece of legislation by gummying up the bill with this stuff?<\/p>\n<h1>Bills Relating to Year Round Daylight Saving Time<\/h1>\n<p>Four states have bill relating to Year Round Daylight Saving Time &#8212; which I&#8217;ll remind you, isn&#8217;t a thing, and probably won&#8217;t ever be a thing.\u00a0 Pardon me jumping on my bandwagon, but why states continue waste their legislatures&#8217; time to propose this junk is beyond me.<\/p>\n<ul>\n<li>Connecticut &#8211; <a href=\"https:\/\/www.cga.ct.gov\/asp\/CGABillStatus\/CGAbillstatus.asp?which_year=2017&amp;selBillType=Bill&amp;bill_num=SB33\" target=\"_blank\">SB 33<\/a><\/li>\n<li>Missouri &#8211; <a href=\"http:\/\/www.house.mo.gov\/bill.aspx?bill=HJR5&amp;year=2017&amp;code=R\" target=\"_blank\">HJR 5<\/a><\/li>\n<li>Mississippi &#8211; <a href=\"http:\/\/billstatus.ls.state.ms.us\/2017\/pdf\/history\/HB\/HB0307.xml\" target=\"_blank\">HB 307<\/a> and <a href=\"http:\/\/billstatus.ls.state.ms.us\/2017\/pdf\/history\/HB\/HB0449.xml\" target=\"_blank\">HB 449 <\/a><\/li>\n<\/ul>\n<p>Connecticut already had an entry in the first section above, but someone in the Senate apparently thinks they&#8217;re smarter than the House and wants to try the impossible here. The full text wasn&#8217;t available last I looked, so I&#8217;ll wait to comment further.<\/p>\n<p>Missouri&#8217;s bill is available, and there&#8217;s plenty to comment on here.\u00a0 Their bill proposes first to be &#8220;exempted from the daylight saving time provisions of 15 U.S.C. Section 260a.&#8221;\u00a0 So they make it sound like they&#8217;re just abolishing DST.\u00a0 But then they go on to say that in March of 2020 they will &#8220;switch clocks to daylight saving for the last time and the use of daylight saving time for public purposes will be eliminated&#8221;.\u00a0 So they just want to opt out of the US Code and do what they want, which is apparently &#8220;go on DST but not use DST.&#8221;\u00a0 What???\u00a0 Who dreams this stuff up?\u00a0 Hopefully not another &#8220;state&#8217;s rights&#8221; activist hoping to buck the feds.\u00a0 The only sensible thing in this bill is to put this to a vote of the people.<\/p>\n<p>Mississippi&#8217;s two bills are identical, and both in the House.
